Welcome to Novaform ("we", "us", "our"). By accessing or using our website, mobile application, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.

1. Acceptance of Terms

By creating an account, purchasing tokens, or using any of our AI design tools, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy. If you do not agree, you must not use the Service.

2. Description of Service

Novaform provides AI-powered interior and exterior design visualization tools. Our Service allows users to upload photographs and apply AI-generated modifications including but not limited to: room restyling, wall recoloring, virtual staging, object removal, house morphing, garden redesign, floor design, and architectural visualization.

3. Account & Eligibility

You must be at least 18 years old to use the Service.
You are responsible for maintaining the confidentiality of your account credentials.
You agree to provide accurate and current information during registration.
We reserve the right to suspend or terminate accounts that violate these Terms.

4. Tokens & Payments

Access to AI generation tools requires tokens, which may be purchased through our website or in-app purchase.
Token packages are non-refundable once purchased, except as required by applicable law.
Prices are subject to change. Any price changes will not affect previously purchased tokens.
We may offer promotional or bonus tokens at our discretion, which may have separate expiration terms.

5. Subscriptions

Subscription plans auto-renew unless cancelled at least 24 hours before the end of the current period.
You may cancel your subscription at any time through your account settings or the applicable app store.
No refunds will be provided for partial subscription periods.

6. Acceptable Use

You agree not to:

Use the Service for any illegal or unauthorized purpose.
Upload content that infringes on third-party intellectual property rights.
Upload content that is obscene, defamatory, or harmful.
Attempt to reverse-engineer, decompile, or disassemble any part of the Service.
Use automated scripts, bots, or scrapers to access the Service.
Resell or redistribute AI-generated outputs for commercial use without proper licensing.
Circumvent or attempt to circumvent any usage limits, rate limits, or access controls.

7. Fair Usage Policy

To ensure optimal service quality for all users, Novaform implements a fair usage policy. Users who engage in exceptionally high-volume usage patterns may experience adjusted processing times. We define "fair usage" as usage consistent with normal personal or professional design workflows. Automated, bulk, or commercially excessive usage beyond typical individual needs may be subject to additional processing delays, temporary access restrictions, or requirement to upgrade to an enterprise plan. We reserve the right to modify fair usage thresholds at any time to maintain service stability and quality for all users.

8. Intellectual Property

You retain ownership of any original photographs you upload to the Service.
AI-generated outputs are provided for your personal and professional use. You may use generated images for interior design presentations, real estate listings, and personal projects.
The Novaform platform, including its design, code, algorithms, and branding, remains our exclusive property.
We may use anonymized, non-identifiable generated content to improve our AI models and Service quality.

9. Disclaimers

AI-generated images are approximations and may not exactly represent real-world results.
The Service is provided "AS IS" without warranties of any kind, express or implied.
We do not guarantee uninterrupted or error-free service availability.
Color accuracy in generated images may vary depending on screen calibration and lighting conditions.

10. Limitation of Liability

To the maximum extent permitted by law, Novaform shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the Service.

11. Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of information as described therein. Uploaded images are processed for the sole purpose of generating design outputs and are not shared with third parties.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or prominent notice on our website. Continued use of the Service after changes constitutes acceptance of the modified Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Novaform operates, without regard to its conflict of law provisions.
